Gooma App User Agreement

Effective Date: February 12, 2025

Welcome to Gooma! This User Agreement ("Agreement") governs your use of the Gooma mobile application ("App") provided by Gooma AI, located in California, United States. By downloading, accessing, or using the App, you agree to the terms and conditions set forth in this Agreement. If you do not agree with these terms, please refrain from using the App.

1. Eligibility

The App is intended for users who are 17 years of age or older. By using the App, you affirm that you are at least 17 years old. If you are under 17, you are not authorized to use the App.

2. Service Provider

This App is offered by Gooma AI, a technology company based in California. For support or inquiries, you can contact us at leylaakustik@gmail.com.

3. Account Registration and Security

In order to access certain features of the App, you may need to create an account. When registering, you agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. If you believe your account has been compromised, you must notify us immediately.

4. Use of the App

By using the App, you agree to:

• Use the App only for lawful purposes.
• Not engage in activities that could harm or disrupt the App, including attempting to gain unauthorized access to the App or its services.
• Not use the App to transmit or distribute harmful or offensive content.

You are responsible for ensuring that your use of the App complies with all applicable laws and regulations.

5. Prohibited Activities

You agree not to engage in any of the following activities while using the App:

• Uploading, posting, or sharing content that is illegal, infringing upon intellectual property rights, defamatory, obscene, offensive, or harmful.
• Attempting to reverse-engineer, decompile, or otherwise interfere with the App’s source code or functionality.
• Using the App to conduct fraudulent or malicious activities, including phishing, spamming, or transmitting malware.

We reserve the right to suspend or terminate your account and access to the App if you engage in any of these prohibited activities.

6. Privacy and Data Collection

Your use of the App is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to the data practices described in the Privacy Policy.

7. Third-Party Services

The App may integrate with or link to third-party services. We do not control or endorse these third-party services and are not responsible for their content, policies, or actions. By using the App, you acknowledge and agree that Gooma AI is not liable for any interactions you have with third-party services.

8. Termination of Access

We reserve the right to suspend or terminate your access to the App at our discretion, without notice, for violations of this Agreement, illegal activities, or any other reason deemed necessary. Upon termination, your right to use the App will immediately cease.

9. Limitation of Liability

To the fullest extent permitted by law, Gooma AI is not liable for any damages or losses resulting from your use or inability to use the App, including but not limited to any direct, indirect, incidental, special, or consequential damages. This includes loss of data, interruptions in service, or personal injury.

10. Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising from this Agreement will be resolved in the appropriate courts located in California.

11. Modifications to This Agreement

We may revise and update this Agreement from time to time. When we make changes, we will post the updated Agreement within the App, and the revised terms will become effective as soon as they are posted. Your continued use of the App after any changes indicates your acceptance of the updated Agreement.
